CruisingWithAI is a free community platform for tracking ducks and custom creations hidden on cruise ships, at ports, and in other public locations worldwide. Users register physical ducks and custom items with QR-code stickers, hide them in public places, and log when they find items hidden by others. Each item builds an append-only journey across multiple finders. Community members can submit custom-designed ducks and 3D-printed creations to be tracked through the platform. Users can create accounts to manage their hatched items, follow items they have found, and share journeys on social media.

Except as otherwise provided herein, the Parties may litigate in court to compel arbitration, stay proceedings pending arbitration, or to confirm, modify, vacate, or enter judgment on the award entered by the arbitrator.
If for any reason, a Dispute proceeds in court rather than arbitration, the Dispute shall be commenced or prosecuted in the state and federal courts located in Tarrant, Texas, and the Parties hereby consent to, and waive all defenses of lack of personal jurisdiction, and forum non conveniens with respect to venue and jurisdiction in such state and federal courts. Application of the United Nations Convention on Contracts for the International Sale of Goods and the Uniform Computer Information Transaction Act (UCITA) are excluded from these Legal Terms.
In no event shall any Dispute brought by either Party related in any way to the Services be commenced more than one (1) years after the cause of action arose. If this provision is found to be illegal or unenforceable, then neither Party will elect to arbitrate any Dispute falling within that portion of this provision found to be illegal or unenforceable and such Dispute shall be decided by a court of competent jurisdiction within the courts listed for jurisdiction above, and the Parties agree to submit to the personal jurisdiction of that court.
The Parties agree that any arbitration shall be limited to the Dispute between the Parties individually. To the full extent permitted by law, (a) no arbitration shall be joined with any other proceeding; (b) there is no right or authority for any Dispute to be arbitrated on a class-action basis or to utilize class action procedures; and (c) there is no right or authority for any Dispute to be brought in a purported representative capacity on behalf of the general public or any other persons.
The Parties agree that the following Disputes are not subject to the above provisions concerning informal negotiations binding arbitration: (a) any Disputes seeking to enforce or protect, or concerning the validity of, any of the intellectual property rights of a Party; (b) any Dispute related to, or arising from, allegations of theft, piracy, invasion of privacy, or unauthorized use; and (c) any claim for injunctive relief. If this provision is found to be illegal or unenforceable, then neither Party will elect to arbitrate any Dispute falling within that portion of this provision found to be illegal or unenforceable and such Dispute shall be decided by a court of competent jurisdiction within the courts listed for jurisdiction above, and the Parties agree to submit to the personal jurisdiction of that court.

We reserve the right to correct any errors, inaccuracies, or omissions and to change or update the information on the Services at any time, without prior notice.

TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, IN CONNECTION WITH THE SERVICES AND YOUR USE THEREOF, INCLUDING, WITHOUT LIMITATION, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE MAKE NO WARRANTIES OR REPRESENTATIONS ABOUT THE ACCURACY OR COMPLETENESS OF THE SERVICES' CONTENT OR THE CONTENT OF ANY WEBSITES OR MOBILE APPLICATIONS LINKED TO THE SERVICES AND WE WILL ASSUME NO LIABILITY OR RESPONSIBILITY FOR ANY (1) ERRORS, MISTAKES, OR INACCURACIES OF CONTENT AND MATERIALS, (2) PERSONAL INJURY OR PROPERTY DAMAGE, OF ANY NATURE WHATSOEVER, RESULTING FROM YOUR ACCESS TO AND USE OF THE SERVICES, (3) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SECURE SERVERS AND/OR ANY AND ALL PERSONAL INFORMATION AND/OR FINANCIAL INFORMATION STORED THEREIN, (4) ANY INTERRUPTION OR CESSATION OF TRANSMISSION TO OR FROM THE SERVICES, (5) ANY BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE WHICH MAY BE TRANSMITTED TO OR THROUGH THE SERVICES BY ANY THIRD PARTY, AND/OR (6) ANY ERRORS OR OMISSIONS IN ANY CONTENT AND MATERIALS OR FOR ANY LOSS OR DAMAGE OF ANY KIND INCURRED AS A RESULT OF THE USE OF ANY CONTENT POSTED, TRANSMITTED, OR OTHERWISE MADE AVAILABLE VIA THE SERVICES. CruisingWithAI is a tracking platform for physical ducks and custom items hidden by users in public locations. Users acknowledge and agree that: (a) physical ducks and items hidden in public locations are subject to being moved, taken, lost, damaged, discarded, or destroyed by other persons, cruise lines, port authorities, environmental factors, or any other causes outside of CruisingWithAI's control; (b) CruisingWithAI does not own, manage, transport, retrieve, or otherwise control any physical ducks or items registered through the Service; (c) CruisingWithAI makes no guarantees that any duck or item hidden in a public location will remain in that location, be findable, or generate further events; and (d) CruisingWithAI is not responsible for any loss, damage, theft, or destruction of any physical duck or item. Users bear all risk associated with hiding, transporting, or attempting to retrieve any physical item.
Users are solely responsible for complying with the rules, policies, and regulations of any cruise line, port authority, hotel, public venue, transportation provider, or other location where ducks or items are hidden. CruisingWithAI does not endorse, recommend, or guarantee that hiding ducks is permitted at any specific location, ship, port, or venue. Some cruise lines and venues prohibit or restrict the hiding of objects; users must verify and comply with applicable rules before hiding any item. CruisingWithAI is not liable for any consequences arising from a user's violation of any cruise line, venue, or location-specific rules.
Users may submit location data (including GPS coordinates and text descriptions) when logging duck events. CruisingWithAI does not verify the accuracy of any submitted location data, and users acknowledge that location data may be incorrect, falsified, or inaccurate. CruisingWithAI is not responsible for any consequences arising from inaccurate location data, including but not limited to a user traveling to a location based on submitted data. Users acknowledge that physical ducks are not retrievable through CruisingWithAI's Service.
The role of "hatcher" — the person who originally registered a duck or item through CruisingWithAI's Service — is permanent and may not be transferred, sold, or reassigned to another user. CruisingWithAI reserves the right to label any registered hatcher as "Mystery Hatcher" at the user's request or for privacy reasons. Any attempt to falsely claim authorship of a duck, item, or event submission may result in account termination, content removal, and forfeiture of any associated journey history.
